Terms and Conditions of Use
These Terms and Conditions of Use (hereinafter referred to as “Terms”) govern the use of the Website https://telos.care/ (hereinafter referred to as the Website) and the Telos Care Application (hereinafter referred to as the Application) and the content made available through it, as well as the relationship between you (hereinafter referred to as the User) and TELOS, LDA, legal entity No. 518905152, registered at the Commercial Registry Office under the same number, with headquarters at Rua Hermano Neves, No. 18, Floor 3, Office 7 V5079, 1600-477 Lisbon, Portugal, with a share capital of €5,000.00 (five thousand euros).
1. General Conditions
1. By accessing and using the Website and the Application, the User expresses their agreement and acceptance of these General Conditions of Use.
2. If the User does not fully accept any of the conditions set forth in the Terms and Conditions presented, they should not access/use the Website and the Application.
3. TELOS reserves the right to change these terms and conditions in whole or part at any time, as well as to add, update, or delete them in whole or in part, without prior notice, and such changes will always be published on the Website or in the Application. Therefore, the user should consult this information as regularly as possible.
4. All information contained on the Website and on the Application is intended exclusively for private use and may not be used for commercial purposes.
5. Access to the Website and the Application may be subject to limitations as a result of legislation or functional availability in some countries, and it is the User's responsibility to check for the existence of such limitations.
6. Use of the Website and Application is restricted to Users of legal age, in accordance with the legislation of each country where they reside, unless consent has been given by the Legal Guardians of minors.
7. If you become aware that a minor User is using the Website and/or Application without the consent of their legal guardians or on their behalf, please inform TELOS using the contact details provided in these Terms so that TELOS can take the appropriate measures to immediately delete the minors' information from its system.
2. Restrictions of Use
1. The Application is not currently compatible with all mobile device operating systems.
2. To use the Application, you need a smartphone with a compatible operating system and, for some features, an internet connection.
3. The following minimum requirements currently apply to the use of the Application:
- iPhone (iOS 16.0 or later);
- iPad (iPadOS 16.0 or later);
- Mac (macOS 12.0 or later and Apple M1 processor or later);
- Apple Vision (requires VisionOS 1.0 or later);
- Android 7.0.
4. In order to provide the service to the User as contractually defined, the Application only supports versions of its respective operating systems that are officially supported by Apple and Android.
5. Smartphone operating systems that have been modified by end Users (especially jailbreaks, custom ROMs, or comparable modifications of the operating system by the end User) are specifically excluded.
6. The Application also does not support operating system versions or devices that are no longer officially supported by the manufacturers.
7. Future restrictions may be applied to supported operating system versions to ensure the stability, security, and functionality of the Application.
3. Data Transmission
1. Data transmission costs may be incurred when transmitting data from the Website and the Application between the User's computer or mobile device and the servers. These costs are charged by the internet provider. Users can check the specific costs of data transmission with their internet provider.
2. TELOS is not an operator of mobile devices or platforms on which applications are distributed (“app stores”), so these Terms do not apply to the relationship between the User and the app store operator or the operator of the User's mobile device. In such cases, the Terms of the respective operators apply, which the User should be familiar with.
4. User Responsibility
1. The User must inform TELOS as soon as possible if they suspect that third parties have gained unauthorized access to the User's account. The same applies if the User becomes aware that TELOS' rights have been violated by third parties.
2. If TELOS' rights are infringed by third parties or unauthorized access to the User's account occurs, and the User can contribute to the defense of these rights or the clarification of unauthorized access, the User must cooperate with TELOS in defending its rights. This support refers, in particular, to the provision of relevant information and documents.
3. The User is not permitted to do the following while using the Website and the Application (non-exhaustive list):
1. Create multiple accounts for the same person;
2. Violate the law and good manners with their behavior as a user (e.g., in the usernames used, comments, or photos uploaded);
3. Use the Website and Application for illegal purposes;
4. Infringe commercial property rights and copyrights or other property rights, being prohibited from copying, altering, translating, adapting, merging, or distributing any content from the Website and Application without written authorization from TELOS;
5. Transmit content with viruses, so-called Trojan horses, or other programming that may damage the software;
6. Insert, store, or send links or content for which you are not authorized, especially if such links or content violate confidentiality obligations or are illegal;
7. Distribute unsolicited advertising or emails (so-called “spam”) or false warnings about viruses, malfunctions, and the like, or invite participation in sweepstakes, pyramid schemes, chain emails, and similar activities;
8. Use the Website and Application for commercial purposes;
9. Manipulate the functions and content of the Website and Application;
10. Access or attempt to access areas or systems of the Website and Application without permission, including by automated means (scraping, bots);
11. Interfere with the normal operation or security of the Services;
12. Bypass, disable, decrypt, or circumvent technical measures implemented to protect the Website, the Application, and their content, or make unauthorized modifications of any kind to the User's terminal device, e.g., disabling hardware or software controls (“jailbreaking”);
13. Reverse engineer or extract or attempt to extract the source code.
4. The User undertakes to ensure the security of identification elements, as well as their strictly personal use, namely:
1. Not allowing their use by third parties, even if they are your attorney or representative;
2. Not disclosing them or making them accessible to third parties in any way;
3. Memorizing them and refraining from recording them, either directly or in any form or by any means that are intelligible to third parties.
5. The User undertakes to immediately report any illegal use of the Website and the Application of which they are aware, or any anomalous occurrences, through the customer support contacts indicated in these Terms, namely:
1. The occurrence of an unsolicited operation;
2. The incorrect execution of a requested operation.
6. The User must regularly check the Terms of the Website and the Application and their personal data in order to become aware, as soon as possible, of the occurrences referred to in the previous paragraph and, when these are found, take the necessary measures to immediately ascertain the facts. Whenever an operation is carried out using the procedures referred to in the previous clauses, it is assumed that it was carried out by the User.
7. The User is responsible for the use of the Website and the Application, which, even if carried out by third parties, with or without their authorization, is assumed, for all contractual and legal purposes, to have been carried out by them. If, however, it is proven that the transaction was carried out by a third party, it will be presumed that this was consented to or culpably facilitated by the User.
8. When personally carrying out any transaction or communicating data to TELOS, the User must take special care not to make typing or communication errors, in order to ensure that the transaction is carried out correctly.
9. Any order duly transmitted is irrevocable. Whenever the validity, effectiveness, or proof of a given transaction depends on compliance with certain formalities, the transaction will only be completed after these formalities have been fulfilled.
10. The User and TELOS agree that the computer record or its reproduction on any medium - namely on paper - constitutes proof of the transactions carried out in accordance with the procedures set out in these terms and conditions.
11. In the event of death, absence, interdiction, or incapacitation of the User, the right to use the Website and the Application shall expire.
12. Errors or deficiencies arising from the means of access used by the User may not be invoked against TELOS.
13. TELOS does not guarantee uninterrupted access to the Application and the Website, which may be subject to limitations, delays, maintenance windows, and other problems inherent in the use of the Internet and electronic communications and therefore cannot be held responsible for the inability of the User to use them.
14. TELOS reserves the right to add, change, or discontinue features of the Website and Application at any time.
5. Access and Intellectual Property
1. By installing and using the Website and the Application, the User acknowledges that the intellectual property rights to all content on the Website and the Application, including information, tools, graphic design with all its components, sound and animation, and all other information, as well as its graphic representation, including trademarks, logos, symbols, and the layout and structure of the Application and Website, are protected by intellectual property rights, are the property of TELOS, and undertakes to respect those rights.
2. The total or partial reproduction of any information or content on the Website and Application, or its rental or sale, is not permitted without the prior authorization of TELOS.
3. The distinctive signs of the Website and Application may not, under any circumstances, be used by third parties without the prior and express authorization of TELOS.
4. The User is strictly prohibited from any act or attempt to access, transmit, publish, modify, reproduce, distribute, sell, license, copy, or use the content and intellectual property of the Website and Application, in whole or in part, without the prior written authorization of TELOS.
6. Access to Information
1. The Application (Telos Care) is a wellness application and not a medical device.
2. The information available in the Application is intended to clarify and inform Users about aspects related to the activity and services provided by TELOS, and the information is merely indicative.
3. Any insights, metrics, or suggestions are merely indicative and may be affected by device and data limitations.
4. TELOS is not responsible for any errors or inaccuracies that may be contained in the Application or on the Website.
5. TELOS does not provide any medical advice, diagnosis, or treatment through the Website and Application, nor does it intend to replace any medical advice, diagnosis, treatment, or healthcare management.
6. Users should not rely solely on the Application to make medical decisions and should consult healthcare professionals for medical advice.
7. Use of the Website and Application does not exempt or replace consultation and provision of medical services.
8. If you believe you are experiencing a medical emergency, call your country's emergency number immediately.
7. Links to Third-party Websites
1. The content of the Website and Application may contain links to third-party websites. As these are not controlled by TELOS, they are not responsible for their content.
2. TELOS is not responsible for the Privacy Policies of any other websites, where neither the Privacy Policy nor the Terms of this Website and Application will apply.
3. The use of these third-party pages is the sole responsibility of the Users.
4. The creation of links to the Website https://telos.care requires prior written authorization.
8. Provision and Processing of Personal Data
1. Accessing the Website and Application does not automatically and mandatorily entail the provision of personal data by the user.
2. The User may remain anonymous while browsing the Website or Application.
3. However, an account may be required to use certain features.
4. If you wish to create an account, you must provide TELOS with certain personal data, such as your email address and name, which will be duly processed by TELOS.
5. The information provided by the User must be accurate, complete, and up to date.
6. Therefore, the data made available on the TELOS Website and Application should not be processed without prior authorization for its collection and processing.
7. Protecting the data of users of the Website and Application is a priority for TELOS. Therefore, if you would like more information about how your personal data is processed, please consult our Privacy Policy available at https://telos.care/privacy-policy/. In any case, Users will always have the right to access, rectify, and cancel any data that directly concerns them. To do so, simply contact TELOS using the details provided in these Terms.
8. Each User may only register one User account and must not make their user account accessible to third parties. The User account is personal and non-transferable.
9. All information provided by the User must be true and up to date, and any changes to it must be communicated immediately through the customer support contacts indicated in these Terms.
10. During registration, the User is invited to read and accept these Terms. Once the User accepts the Terms, they become part of the relationship between TELOS and the User.
11. In the event of a violation of any applicable legal provision, these Terms, or other applicable contractual terms, TELOS reserves the right to suspend or delete the Account, as well as to take any other measures that, in its sole discretion, it deems appropriate.
12. The User must keep their credentials safe and limit access to their Account, namely by protecting their credentials against loss, theft, or misuse. Any loss of credentials must be immediately reported through the customer support contacts indicated in these Terms.
13. Any damages resulting from the unauthorized use of credentials are the sole responsibility of the User.
14. The User keeps their account active in the Application, even if at any time they delete the Application from their mobile device.
15. The User may request the deletion of their account at any time through the “Settings” and “Delete account” section in the Application.
9. Responsibility
TELOS, LDA is not responsible for errors that may occur due to system irregularities, failure (temporary or permanent) of the Application, Website, applications, or other tools. TELOS is not responsible for any damages resulting from misuse or inability to use the Application or Website.
10. User Content and Responsibility
1. Users are responsible for the accuracy and integrity of the information they enter into the Application.
2. Users remain the owners of the information they enter.
3. By entering information, Users authorize TELOS to host and process that information solely for the purpose of providing and improving the Services, in accordance with the Privacy Policy.
4. TELOS, LDA may remove content that violates these Terms or the law.
11. Third-party Services and Integrations
Some features may depend on services provided by third parties (e.g., app stores, health platforms and devices, hosting, analytics). These services are governed by their own terms and privacy policies, for which TELOS, LDA is not responsible.

13. Validity of the Terms of Use
1. If any provision of these Terms of Use is unenforceable or conflicts with applicable legal regulations, the validity of the remaining provisions shall not be affected, and the affected provision shall be deemed replaced by one that is enforceable or legally permissible with the same or similar meaning.
2. The language of these Terms is English. To the extent that copies of these provisions are translated into other languages, the English version of these provisions shall prevail in the event of any contradiction.
3. In the event of any violation of these Terms by the User, TELOS reserves the right to take any and all legally available actions, as well as the right, at its discretion, to terminate access to and/or use of the Website and the Application, with or without notice to the User.
14. Applicable Law and Jurisdiction
1. The Website and the Application, as well as these Terms, are subject to Portuguese law.
2. Any dispute arising in relation to the existence, validity, effectiveness, interpretation, application, or integration of these Terms shall be submitted to the competent court of the Judicial District of Lisbon, with express waiver of any other.
