1. Acceptance of Terms and Conditions of Use

By using the Telos Care website and app (the "Services"), the User acknowledges that they are accepting these Terms and Conditions of Use.

2. Changes to Terms and Conditions of Use

TELOS, LDA reserves the right to, at any time, without prior notice and with immediate effect, change, add, update or eliminate, partially or totally these Terms and Conditions of Use.

The User should periodically consult this page to check if any updates or modifications have occurred. Material changes may be communicated in-app or by email when appropriate.

3. Access to the Service

TELOS, LDA has the exclusive right to at any time, suspend, partially or totally, access to the app and website, especially in management, maintenance, repair, alteration or modernization operations and to close, permanently or temporarily, partially or totally, at any time, according to its will, the app, website or any of the services, without prior notice.

4. Intellectual Property Rights

The User acknowledges that the contents of this app and website are protected by intellectual property rights and undertakes to respect such rights.

The rights over texts, images, graphics, sound and animation and all other information, as well as their graphic representation, including brands, logos, symbols and the layout and structure of the app and website are owned by TELOS, LDA or licensed to it.

The User is not authorized to transmit, publish, modify, copy, sell, use or distribute, in any way, the texts, images or other information contained in the app and website without prior written authorization from TELOS, LDA. The use of brands and logos and the availability of materials do not grant permission to use such brands, logos or materials.

5. Personal Data

Use of the Services does not necessarily imply the provision of personal data. However, if you wish to create an account, you must provide us with some data, such as your email address and name, which will be processed under the terms defined in the Privacy Policy, available on this website.

6. Information

The information available on the Services aims to clarify and inform Users about aspects related to the activity and services provided by TELOS, LDA. Although subject to careful review, such information is indicative, may contain errors or inaccuracies, and does not dispense, for example, consultation with medical services. Telos Care is a wellness application and not a medical device. It does not provide medical advice, diagnosis, or treatment.

7. Liability

TELOS, LDA will not be liable for errors that may occur due to system irregularities, failure (temporary or permanent) of the app, website, applications or other tools. TELOS, LDA is not responsible for any damages resulting from improper use or inability to use the app or website.

8. Links

The Services may provide links to pages of other entities. These sites are not owned, operated or controlled by TELOS, LDA, so we are not responsible for, nor do we endorse or subscribe to, the content of those sites or of sites linked to them or referenced therein. The use of these links is the sole responsibility of Users.

The creation of links to the telos.care website requires prior written authorization.

9. Age and Eligibility

The Service is intended for individuals over the age of majority under applicable laws where they reside (the "Age of Majority"), unless a valid parental or guardian approval and consent has been obtained in accordance with applicable laws. Under no circumstances should the Service be used by individuals below the Age of Majority without such consent.

We do not knowingly collect Personal Data from anyone below the Age of Majority without the required parental or guardian consent. If you discover that a child has used the Service without your consent, or that someone has been using the Service for or on behalf of your child without your consent, please contact us using the details in Section 19 (Contact). We will take reasonable steps to delete the child's information from our active systems and backups.

10. Accounts

To use certain features you may need an account. The User must provide accurate, complete and up-to-date information and keep login credentials confidential. The User is responsible for all actions carried out under their account. TELOS, LDA may suspend or close accounts in case of breach of these Terms or applicable law.

11. User Content and Responsibilities

Users are responsible for the accuracy and completeness of information they enter into the app. Users should not rely solely on the app for medical decisions and should consult healthcare professionals for medical advice.

The User remains the owner of the information they enter. By entering information, the User authorizes TELOS, LDA to host and process such information only to provide and improve the Services, under the terms of the Privacy Policy. TELOS, LDA may remove content that breaches these Terms or the law.

12. Acceptable Use

The User shall not: (a) use the Services for unlawful purposes; (b) copy, alter, translate, adapt, merge, or distribute the Services or their content without authorization; (c) attempt to access areas or systems without permission, including by automated means (scraping, bots); (d) introduce viruses or other harmful code; (e) interfere with the normal operation or security of the Services; (f) reverse engineer or attempt to extract source code, except to the extent permitted by applicable law.

13. Third-Party Services and Integrations

Some features may depend on services provided by third parties (for example, app stores, device health platforms, hosting, analytics). Those services are governed by their own terms and privacy policies, for which TELOS, LDA is not responsible.

14. Service Availability and Changes

While we strive to maintain continuous service availability, TELOS, LDA does not guarantee uninterrupted access to the app and website. The Service may be subject to limitations, delays, maintenance windows, and other problems inherent in the use of the internet and electronic communications. We may add, change or discontinue features at any time.

15. Health and Safety

Telos Care is a wellness application intended for general informational purposes only. It is not a medical device and does not provide medical advice, diagnosis or treatment. The Services are not suitable for emergencies or acute conditions. If you believe you are experiencing a medical emergency, call the emergency number in your country immediately. Any insights, metrics or suggestions are indicative only and may be affected by device and data limitations.

16. Security

We implement reasonable technical and organizational measures to protect personal data. However, no system is completely secure and we cannot guarantee absolute security. The User must promptly notify us of any suspected unauthorized use of their account.

17. Termination

The User may stop using the Services at any time. TELOS, LDA may, at any time, suspend or terminate access to the Services in case of breach of these Terms or for security, legal or operational reasons. Provisions which by their nature should remain in force will continue to apply.

18. Disclaimers

The Services are provided "as is" and "as available". TELOS, LDA does not guarantee that the Services will be uninterrupted, timely, secure or free of errors, or that the information provided is accurate, complete or up-to-date.

20. App Stores

If the app is downloaded from an app store, the User must comply with the respective store rules. To the maximum extent permitted by law, the app store provider is not responsible for the functioning or support of the app. The app store provider and its affiliates may be third-party beneficiaries of this clause.

21. Applicable Law and Competent Jurisdiction

Portuguese Law is applicable to the management, administration, use and application of the Terms and Conditions of Use of the app and website.

For all matters and disputes that may arise, inherent to these Terms and Conditions of Use, the courts of Lisbon have exclusive jurisdiction, with express waiver of any other.

22. Validity of Terms and Conditions of Use

If any part or provision of these Terms and Conditions of Use is not enforceable or is in conflict with applicable law, the validity of the remaining parts or provisions will not be affected. Failure by TELOS, LDA to enforce any provision does not constitute a waiver. These Terms, together with the Privacy Policy (and Cookie Policy, where applicable), constitute the entire agreement regarding the use of the Services.
